1. Application, Definitions

These Terms and Conditions apply to all services provided by Onfocus Services Limited, 5F, The Quayside, 77 Hoi Bun Road, Kwun Tong, Kowloon – Hong Kong (“we”, “our”) via our website https://xberry.shop/ to customers (“you”).

A “consumer” is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An “entrepreneur” is a natural or legal person or a partnership with legal capacity acting in the course of a commercial or self-employed activity.

2. Conclusion of Contract

Products presented on our website do not constitute binding offers. You make a binding offer to purchase by completing the order process. After placing an order, you will receive an order confirmation by email. A contract is concluded only upon our confirmation.

3. Subject of the Contract

The subject includes the sale of goods, services, and digital content as described in the product listings. Restrictions such as system requirements are outlined in the respective descriptions.

4. Prices, Payment, Delivery

All prices are total prices including applicable taxes. Shipping costs are shown separately. Payment is due in advance unless otherwise agreed. Accepted payment methods are listed on the checkout page. Delivery typically occurs within 2 business days after payment receipt.

5. Retention of Title

Ownership of the goods remains with us until full payment has been made.

6. Right of Withdrawal

Consumers in the EU and other applicable jurisdictions have the right to withdraw from the contract. Details are provided in our withdrawal policy.

7. Liability

We are liable only for intent and gross negligence, except for injury to life, body, or health, or in the event of a breach of essential contractual obligations. In such cases, liability is limited to foreseeable damages.

9. Warranty

The warranty follows statutory provisions. For business customers, the warranty period is 12 months.

10. Vouchers

Vouchers purchased in our shop are redeemable only within our system unless otherwise noted. They are transferable, but not refundable in cash or interest-bearing.

11. Governing Law and Jurisdiction

The laws of Hong Kong apply. For consumers within the EU, the consumer protection standards of their home country may additionally apply. The place of jurisdiction is Hong Kong.

12. Severability Clause

Should any provision be invalid, the remainder of the contract remains unaffected.

14. Amendments

15. Force Majeure
